Terms of Service

1. Who You Are Agreeing With
Gumly is operated under the trade name Gumly Technologies ("Gumly", "we", "us"). Notices to us, including any legal notice under these Terms, should be sent to support@gumly.tech, and we will confirm receipt.
By creating an account, booking a service, or offering services as a technician, you agree to these Terms. If you do not agree, do not use the platform.
2. What Gumly Is — and Is Not
Gumly is a marketplace. We connect homeowners who want home services with independent technicians who perform them. Gumly does not perform home services. We do not employ technicians, do not supervise how they work, and do not control the methods, tools, or order in which they do a job.
We set the prices shown in the app, collect payment, take a platform fee, and pay the remainder to the technician. That makes us a marketplace, not a referral directory and not a contractor. Where these Terms describe our role in a booking, they describe the operation of the platform, not the performance of the work.
3. Eligibility and Accounts
You must be at least 18 years old. You must give accurate information when you register and keep it current — a wrong address or phone number is the most common reason a booking fails. You are responsible for anything done through your account and for keeping your password confidential. Tell us promptly if you believe your account has been used without your permission.
4. Where and When We Operate
Gumly currently serves a defined list of ZIP codes in the Chicago metropolitan area, Illinois. If your address falls outside that list, we cannot accept a booking, and the app will tell you so at the time you book rather than afterward. Coverage changes as we expand; the list in the app is always the operative one.
All dates and times are handled in U.S. Central Time (America/Chicago), regardless of where you happen to be when you book.
5. Booking, Scheduling and the Waitlist
- Appointments are booked into fixed arrival windows beginning at 9:00 AM, 11:00 AM, 1:00 PM, 3:00 PM and 5:00 PM Central Time. We do not offer same-day, on-demand, or emergency dispatch.
- Bookings can be made up to 30 days in advance.
- Each day has a limited number of appointments. When a day is full it is full — the platform will not accept an additional booking for it, and you may join a waitlist instead.
- A slot time is the start of an arrival window, not a guaranteed arrival minute. Traffic and the length of a preceding job can move an arrival. We will notify you when your technician is en route.
- Joining a waitlist is not a booking and does not hold a place. If a slot opens and you are offered it, the offer may expire if you do not respond.
6. Prices, Estimates and Change Orders
The price shown when you book is an estimate based on the service you selected and the information you gave us. It is not a fixed quote, because neither we nor the technician has seen the job yet.
If the technician finds that the work differs from what was booked, they may issue a revised quote. A revised quote does not take effect unless you approve it. You may approve it, decline it, or cancel the booking. If you decline, the technician may complete only the work already agreed, or the booking may be cancelled under section 8. No one can change the price of your booking without your approval.
Any automated estimate the app produces is an aid to scoping, not an offer, and is reviewed before it is shown to you as a quote.
7. Payment
- Payment is collected through our payment processor, Stripe. We do not receive or store your full card number.
- Payment is charged when the job is marked complete, using the payment method on your account.
- Of each payment, Gumly retains a platform fee and remits the balance to the technician. The fee covers running the platform; it is not a service charge for the work itself. The price you are shown before you confirm a booking is the total you pay.
- Prices shown are exclusive of any applicable taxes unless stated otherwise.
- If a charge fails, we may retry it and will contact you. Work already performed remains payable.
8. Cancellations, Reschedules and No-Shows
You may cancel or reschedule a booking from the app at no charge. If we introduce a cancellation fee, it will be set out in these Terms and shown to you before you confirm a booking — we will not charge a fee that is not stated here.
If nobody is at the property, or the technician cannot safely access the work area, the technician may treat the appointment as a no-show after waiting a reasonable time. We do not currently charge a no-show fee.
If we cancel — because no technician is available, because the address falls outside our service area, or because of weather or an emergency — you are not charged, and we will offer the next available date.
9. Technicians: Independent Contractor Status
Technicians on Gumly are independent contractors. They are not employees, agents, partners, or joint venturers of Gumly. Specifically, a technician:
- chooses which jobs to accept and is under no obligation to accept any;
- sets their own working days and hours by choosing their availability;
- supplies their own tools, vehicle, and materials;
- controls the manner and means by which the work is performed;
- is free to work for other platforms, agencies, or direct clients, including competitors;
- is responsible for their own taxes, insurance, licensing, and any workers they engage.
Technicians represent that they hold every license, certification, registration and insurance policy that applicable law requires for the services they offer, and that these remain valid. Technicians agree to complete identity verification and a background check as a condition of taking jobs on the platform.
Payouts to technicians are made through Stripe Connect, and a technician must complete Stripe's onboarding and verification before any payout can be released.
10. Your Responsibilities as a Customer
You agree to provide safe access to the work area, to secure pets, to disclose known hazards (for example asbestos, mould, faulty wiring, or a structural problem), and to be reachable at the number on your booking. You confirm that you own the property or are authorised to have the work done. Technicians may decline or stop work they reasonably judge unsafe, and may leave if they are subjected to threatening or abusive behaviour.
11. Prohibited Conduct
You may not use Gumly for an unlawful purpose; misrepresent your identity, address, or qualifications; harass, threaten, or discriminate against another user; interfere with the platform's operation or security; scrape or bulk-collect data from it; or arrange work off-platform with a technician you met through Gumly in order to avoid fees.
12. Disclaimers
The platform is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Gumly does not perform the services and does not warrant the work of any technician. Verification and background checks reduce risk; they do not guarantee a technician's conduct, workmanship, or results. Arrival times, availability, and automated estimates are predictions, not promises.
13. Limitation of Liability
To the fullest extent permitted by law, Gumly is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of use, arising out of your use of the platform.
Our total liability for any claim relating to a booking is limited to the amount you paid for that booking. Nothing in these Terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.
Because technicians are independent contractors, claims arising from how work was performed lie against the technician. We will provide the information reasonably necessary for you to pursue such a claim.
14. Indemnification
You agree to indemnify Gumly against claims, losses, and reasonable legal costs arising from your breach of these Terms, your misuse of the platform, or — if you are a technician — from the services you perform and your status as an independent contractor.
15. Complaints and Dispute Resolution
Step one: tell us. If something is wrong with a completed job, contact support within 48 hours of completion. Most issues are resolved directly, by arranging a return visit or a refund. Raising a problem promptly matters, because a technician can often put right within days what cannot be evidenced weeks later.
Step two: formal notice. If support cannot resolve it, either of us may send the other written notice describing the dispute and the resolution sought, to support@gumly.tech. We each agree to work in good faith for 30 days from that notice before starting formal proceedings.
Step three. If the dispute is still unresolved after that period, either of us may bring it before the courts identified in section 16. These Terms do not require arbitration and do not waive your right to bring or join a class action.
Nothing here prevents either of us from seeking urgent injunctive relief, or from bringing an individual claim in small claims court.
16. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to its conflict-of-laws rules. Any proceeding will be brought in the state or federal courts located in Cook County, Illinois, and we each consent to their jurisdiction. This does not remove consumer protections that the law of your home state gives you and that cannot be waived by agreement.
17. Suspension and Termination
You may stop using Gumly and close your account at any time — see the Privacy Policy for how to have your data deleted. We may suspend or close an account that breaches these Terms, that we reasonably believe is being used fraudulently, or where a technician's verification, licensing, or background check lapses. Bookings already completed remain payable, and sections 12 through 16 survive termination.
18. Changes to These Terms
We may update these Terms. If a change materially affects your rights, we will give notice in the app or by email before it takes effect. Continuing to use Gumly after that date means you accept the updated Terms. If you do not accept them, stop using the platform and ask us to close your account.
